OC Register: State to Anaheim: Angel Stadium sale violates affordable housing law

Anaheim has several options to address legal concerns with the Angel Stadium sale, but it may not be able to close escrow on the deal unless it first backs up and solicits proposals from affordable housing developers, puts the property out for competitive bidding or significantly changes the mix of homes versus commercial development allowed on the 150-acre site. If not, it faces a fine of about $96 million.

City leaders are faced with some big decisions, after state Housing and Community Development officials issued a notice Wednesday morning that the stadium deal violated the Surplus Land Act. The letter came after a lengthy investigation and months of negotiations between the city and state.

In the deal that was approved in December 2019, city officials agreed to sell the stadium and surrounding land to SRB Management, Angels owner Arte Moreno’s business partnership, in exchange for $150 million in cash and another $170 million in community benefits including affordable housing and a large public park, which SRB would build for the city as part of the development.

Moreno has proposed construction of up to 5,175 residential units, plus two hotels, shops and offices; the plan would also reserve space for a new baseball stadium (though Moreno hasn’t said whether he’ll build new or renovate the existing facility). In addition to the 466 affordable homes that would come from the city’s contribution to community benefits, SRB pledged to add 311 more, for a total of 777 affordable units – 15% of the total.

Any of the apparent remedies to the violation of state law likely would increase the amount of affordable housing to be built in connection with the deal, and every option other than the fine would up the number of affordable units on the stadium site. (Under the law, financial penalties for violations are set aside to pay for affordable housing, but that could be built elsewhere in the city.)

Anaheim has 60 days to correct the violation, according to the letter.

City officials continue to assert that the stadium sale didn’t violate the Surplus Land Act, which is intended to spur development of affordable housing, because the law doesn’t apply in this case.

“We remain committed to our stadium proposal,” Anaheim spokesman Mike Lyster said. “We have been aware of and complied with the Surplus Land Act and other state law allowing for the sale of government property. We respectfully disagree with any suggestion otherwise. This is a matter of reasonable people reasonably disagreeing.”

Lyster said it would be premature to discuss what solutions the city may pursue, but added, “we have many paths forward ahead of us.”

SRB Management spokeswoman Marie Garvey said the company has no comment on the issue at this time.

There is more than enough high density housing in Southern Cal... They are even ripping the old Orange Mall and the Theater at Main & Katella and putting in more high density housing...

The State wants LOW INCOME section 8....

On new builds that doesn't equate land cost wise in the OC.

Why doesn't the State force Disney to build low income housing instead of hotels?...Because Disney backs the Governor and contributes to Newsom..

It's all relative.

I really think we should all hate bodybuilders.  They control too much of the muscle in our society, keeping unmuscular people from getting in better shape.

We should probably surgically carve out some of their muscle to give to the girly men.

This is why attorneys are a scurge on society.  A deal like this could not have happened without the expensive evaluation by idiots called attorneys. 

You can blame government but it is really the responsibility of legal counsel to navigate the myriad of land use laws.

I actually think we should develop a drug that prevents muscle loss and increases metabolism, with no long term studies and then require everyone to take it, children included. Because the people that use this drug will find it to be ineffective unless everyone else takes the drug. 

Sort of like how my umbrella doesn't work in the rain unless you are using an umbrella too. 

That way we can all be swole. Infants included.
