This is why I am not in favor of charging folks with hate crimes.  The are very subjective and, more importantly,  they basically say some victims are more important than others.

It's the motivation behind the act that is the determination of whether something is a hate crime, not the specific act. If a person is killed because of the color of his skin or the church he attends, to me, that's much more of a heinous crime that if he had been killed because he was wearing a Rolex.
