That wasn't the issue. The issue was he asked them to take it down, and they refused. Then a judge told them to take it down, and they refused. 

 

They then added insult to injury by publicly berating him and the judge by basically saying they could keep any type of video deemed "newsworthy" up on their site because the Constitution guaranteed them the right. During his deposition, this conversation was recorded:

 

"Q. Well, can you imagine a situation where a celebrity sex tape would not be newsworthy?

A. If they were a child.

Q. Under what age?

A. Four."

 

Jurors also added after their decision, it wouldn't have mattered if he knew he was being filmed, the judgement would not have changed.

 

This guy and anyone I've ever seen speaking for the company, have been gigantic pieces of sh*t since the websites inception. They deserve everything they've gotten.
