Man sues doctors for mocking him while he was unconscious

Sounds like the hospital needs to put a rule against unauthorized recordings into its policy. The dude was unconscious and would not have heard what the doctors had said if he hadn't brought a recording device into a room that the doctors felt was safe enough for their comments. If the hospital doesn't already have a rule against it then they should be subject to this silly lawsuit. If they do already have a rule against it they should countersue for the exact same amount plus legal fees.

If this really did happen, those doctors are unethical pieces of shit. 

 

What is unethical about disliking a guy that prompts a negative response. My gut feeling is this was a setup. The guy was obnoxious to the staff on purpose in order to make a recording of their responses and later claim some sort of damages for eliciting a response that he never received consciously.

The whole story says set up. All of you personal belongings are put in a bag with all of your clothes and you get the spit back gown. The only way he was recording his pre exam instructions was to hide the phone somewhere under the covers. This was not an ooops I forgot I still had my phone on. If he was being bullied in school and did this he would be charged with wiretapping.

I agree, nothing unethical about it.  It was stupid talk.

Why? There isn't a person on this board who hasn't joked about something at work. They had no reason to believe that their conversation would be heard - and it wouldn't have been had they not been recorded without their knowledge, which raises an ethical question on the patient's part. 

 

There is no evidence that any real damage was done. Had they disclosed information about his medical condition to others who had no need to know, that would be a HIPAA violation. Joking with each other during a procedure hardly reaches this level. I see no evidence that the doctors in any way endangered him or caused him any harm.

Welcome to first-responder humor.  It's called black-humor for a reason; it's a way to deal with some of the horrific sights/stresses in the jobs.

 

I'm sure the patient has nothing but great things to say about the Hospital staff who took care of him like professionals; good thing they didn't send him home with a "bug" implant...
